Thank you for choosing Inkaland Explorers (hereinafter, “INKALAND”). By contracting our services, you agree to these Terms and Conditions, which govern all reservations, payments, and participation in tours or excursions organized by our company.
1. Responsibilities and Liability Disclaimer
The client acknowledges that tours may involve inherent risks (accidents, illness, altitude sickness, loss of belongings, delays due to external causes, etc.).
INKALAND will not be held responsible for damages, losses, additional expenses, or inconveniences caused by third parties (airlines, hotels, transportation services, guides, suppliers, weather conditions, social conflicts, or others).
We recommend purchasing travel insurance that covers accidents, health, losses, and cancellations.
The client declares to be in suitable physical and health conditions to participate in the contracted activities.
2. Reservations and Payments
To confirm a reservation, a 50% deposit of the total service cost is required.
The remaining balance must be paid up to 30 days before the start of the tour, unless otherwise agreed in writing.
Accepted payment methods: credit/debit card, bank transfer, PayPal, or Western Union (bank fees or commissions apply depending on the chosen method).
Confirmation of hotels, trains, and services is subject to availability. In case of unavailability, an alternative of equal category will be offered.
3. Cancellations and Refunds
Deposits are non-refundable under any circumstances.
- Cancellations made more than 45 days in advance: An administrative fee of USD 45 per person will apply.
- Cancellations between 20 and 45 days: Administrative fees and supplier penalties (Ministry of Culture, trains, hotels) will apply.
- Cancellations made less than 72 hours before the start date: A penalty of 100% of the tour value will apply.
Tickets to Machu Picchu, Huayna Picchu, Machu Picchu Mountain, and train tickets are non-refundable under any circumstances (supplier policy).
In the event of cancellation by INKALAND (extreme weather, natural disasters, official closures, protests), a rescheduling or travel credit valid for 12 months will be offered.
4. Date Changes
Date changes requested more than 30 days in advance are subject to a minimum operational fee and supplier policies.
Date changes requested less than 30 days in advance will incur additional penalties depending on train, ticket, and hotel rates.
Inca Trail: Once confirmed, it is non-refundable and can only be rescheduled subject to availability, with an additional fee of USD 120 per person.
5. Prices and Rates
All prices are expressed in US dollars (USD).
Rates may vary during festive seasons (Easter, National Holidays, Christmas, New Year).
Prices include only the services specified in the program; they do not include tips, personal expenses, airport taxes, or services not detailed.
6. Documentation and Insurance
The client is responsible for having a valid passport, visa, migration permits, and all necessary travel documents.
The information provided at the time of booking (names, passport details, nationality, etc.) must be accurate. Later modifications may generate penalties according to supplier policies.
We recommend carrying both physical and digital copies of all travel documents.
7. Itineraries
Itineraries are referential and may be subject to modifications due to weather, operational, social, or force majeure reasons, always prioritizing client safety.
INKALAND will not be held responsible for activities not carried out due to delays or cancellations caused by third parties (airlines, trains, roadblocks, strikes).
8. Use of Images and Audiovisual Material
During tours, INKALAND may take photos and videos for promotional purposes. The client accepts this use unless otherwise expressed in writing before the start of the service.
9. Personal Data Protection
INKALAND protects client data in accordance with Peruvian Law N° 29733 – Personal Data Protection Law.
The information provided will be used solely for administrative purposes and to provide tourism services, under strict confidentiality.
10. Jurisdiction and Applicable Law
These Terms and Conditions are governed by Peruvian law.
Any dispute shall be submitted to the jurisdiction of the competent courts of the city of Cusco, Peru.
